TERMS AND CONDITIONS 2011 Cathedral of Joy “Win an iPad for Justice” Raffle Fundraiser
1. Sponsoring Organization – The “Win an iPad for Justice” Raffle Fundraiser (the “Raffle”) is managed and sponsored by Cathedral of Joy, a Washington Non-Profit corporation and recognized tax-exempt church under both Washington State and Federal law (the “Church”).
2. Eligibility – The Raffle is open only to lawful residents of the State of Washington who are 18 years of age or older.
3. Ticket Price – All tickets cost $5.00 and the price must be paid in full by cash at the time of purchase.
4. Odds of Winning – There will be a total of 1,000 tickets sold for the Raffle. Odds of winning are approximately 1 in 1,000.
5. Prize – The only prize in the Raffle is the Grand Prize. The Grand Prize is an Apple iPad 21 “WiFi only Model” equipped with 64 gigabytes of RAM, black in color. The model number for the Grand Prize iPad 2 is MC956LL/A. THE VALUE OF THE GRAND PRIZE IS $699.00 PLUS 8.3% SALES TAX. The Grand Prize will only consist of the iPad 2 as described, including whatever accessories are included in the retail packaging as provided by Apple when the iPad 2 is purchased from the Apple Store as a standalone product. No apps will be included with the iPad 2 other than those apps that are pre-loaded by Apple. Winner is responsible for purchasing any additional accessories desired including, but not limited to, protective covers, additional chargers, or apps. The Grand Prize has been purchased by the Church and is being held in escrow at the Church offices pending delivery to the Winner.
6. Drawing Date/Time/Location – The drawing for the Grand Prize will take place on December 18, 2011 at 11:05 am, at the Church Sanctuary located at 1153 Gage Blvd, Richland, WA 99352, during regularly scheduled Sunday service. The drawing will be conducted by way of random drawing of raffle ticket stubs in a manner reasonably calculated to maximize the random nature of the drawing. Winners need not be present to win.
7. Information Provided – Contestants are responsible for writing clearly and legibly, and providing accurate information on purchased tickets. If the winning ticket has illegible contact information, then, if reasonable efforts to discern the contact information for the winner are unsuccessful, then Church may declare the ticket to be disqualified and may make a subsequent drawing for a winner.
8. Responsibilities of Winner – The Winner will be contacted by telephone, certified letter and email and will have fifteen (15) business days to claim (or make reasonable arrangements to claim) the Grand Prize from the offices of the Church located at: 1153 Gage Blvd, Richland, WA 99352. If the Winner has made no efforts to claim the Grand Prize within that period of time, then the Winner will be disqualified and the Grand Prize may be disposed of according to law, placed into service at the Church,

used for a subsequent raffle, or awarded to a subsequently drawn Winner, at the sole
discretion of the Church. 9. Procedure for Claiming Grand Prize – In order to claim the Grand Prize, the Winner
must do the following. If a Winner declines to take any of these steps, then he/she will be disqualified and a Winner will be re-drawn using the procedure set out in paragraph 5 herein:
a. Claim the prize at the offices of the Church; and b. Sign a raffle winner’s affidavit that will simply involve the Claimant certifying that
he/she has received notice that he/she is the Grand Prize winner, that he/she is taking possession and ownership of the Grand Prize, and that he/she takes responsibility for all personal taxes or fees involved with receiving the Grand Prize; and
c. Complete a W-9 form in its entirety and provide it to the Church. 10.Taxes – With the exception of the sales tax originally paid for by Church to purchase
the Grand Prize, Winner is responsible for all personal fees or taxes (including any income or windfall taxes under State or Federal law) that may come due as a result of winning the Grand Prize. An IRS 1099-Misc filing will be made, using the information provided by Winner’s completed W-9 form, and reporting the value of the Grand Prize as $699.00.
11.Privacy – Any personal information provided by any individuals (“Personal Information”), including the Winner, in the course of this Raffle, will be held by the Church in strict confidence, will be available to Church staff, contractors or volunteers only as necessary to administer the Raffle, and will not be sold or given to any third parties or used in any way for commercial solicitations. The Church will only provide Personal Information to third parties if required by court order (including a search warrant).
12.Applicable Law – These terms and conditions are intended to operate under Washington State law.
13.Venue – Venue for any dispute related in any way to the Raffle shall be proper only in a court of competent jurisdiction in and for the County of Benton, Washington.
14.Mandatory Arbitration – Any and all participants in the Raffle waive their inherent right to seek redress for anything related in any way to the Raffle by way of a lawsuit in a court of law. Rather, it is agreed that any dispute or claim of any sort of damages arising out of, of related in way to, the Raffle, shall be resolved by Binding Arbitration. The rules for such arbitration shall be the Uniform Rules contained within RCW 7.04A and the arbitrator shall be selected by mutual agreement. If the parties are unable to agree upon a mutually acceptable arbitrator, then each party shall select an arbitrator and the two selected arbitrators shall jointly select a third. In any arbitration, the costs of arbitration, and the reasonable attorney’s fees incurred by the most prevailing party, shall be borne by the other party or parties. Any award resulting from Arbitration may only be filed in a court of competent jurisdiction in and for the County of Benton, Washington.
15.Severability – If any portion of these terms and conditions are found, by a court of competent jurisdiction, to be unenforceable, then such portion shall be excised and removed, and the remaining terms and conditions shall continue to apply as if the unenforceable term(s) had never been included in the first place.
